Just two weeks after President David Granger appointed a Tribunal to inquire, investigate and recommend whether Trade Unionist, Carvil Duncan, ought to be removed as Chairman of the Public Service Commission, the public servant has reacted, hinting his refusal to give up the post.

Mr. Duncan, who is currently facing fraud charges in the court over a decision to pay himself back pay as a GPL board member without the permission of the board or company, told media operatives on Wednesday that he will not resign.

“I will not resign because I hold a Constitutional office and my terms in office are set out in my mandate, the instrument given to me,” he said.

Duncan came under criticism for his apparent inability to discharge the functions of his office.

The Tribunal is being led by Justice Roxanne George-Wiltshire, while Justice (Rtd.) Winston Patterson and Attorney-at-Law, Mr. Robert Ramcharran are serving as members.

Duncan said the Tribunal is “Double Jeopardy.”

“You can’t try someone for something that is already being tried in Court,” he added. But the court matter is dealing with the fraud charges, while the tribunal is dealing specifically with his position as Chairman of the Public Service Commission. 

The Commission is expected to render its report, findings and recommendations to the President on or before Monday, October 31, 2016.

President Granger said the government is obliged that when matters are brought to its attention that the response should not be hasty, arbitrary or whimsical, but that they follow the Constitution in spirit.
