High Court throws out AG’s request to discontinue Paul Slowe’s PSC case

While the Judge found that the Attorneys representing the former Police Service Commission might have erred in filing the matter under the Commission's name knowing an expiration date was coming and the Commission members were already suspended, he ruled that the matter could continue with the former Chairman of the Commission, Paul Slowe being made the applicant in the matter.

High Court throws out AG’s request to discontinue Paul Slowe’s PSC case

High Court Judge Gino Persaud this afternoon dismissed an application by Attorney General Anil Nandlall for the case filed by the former Police Service Commission against the President’s decision to suspend the Commission members to be thrown out.

The Attorney-General wanted the substantive case dismissed since the life of the Police Service Commission which filed the case expired while the matter was before the Court.

While the Judge found that the Attorneys representing the former Police Service Commission might have erred in filing the matter under the Commission’s name knowing an expiration date was coming and the Commission members were already suspended, he ruled that the matter could continue with the former Chairman of the Commission, Paul Slowe being made the applicant in the matter.

The Judge said it was not fair for the substantive case to be thrown out simply because the life of the Commission had expired.

With today’s ruling, the substantive case against the Government over the suspension of the PSC members will move forward.

The case seeks a declaration that the President’s suspension of the Chairman and Members of the last PSC was in violation of the laws of Guyana.

The Chairman and members of the former PSC were suspended days before the Chief Justice ruled in the PSC’s favour in a promotion case that was filed by two senior officers who challenged the promotions by the PSC.

While that case went in favour of the PSC, the promotions were never activated by the Police Force. The Police Commissioner is named as a respondent in the substantive matter.
