High Court to hear Police Service Commission case next week

The Police Service Commission is expected to make its case that the President’s suspension of the PSC was unlawful and illegal and not in keeping with the Constitution.

High Court to hear Police Service Commission case next week

Two weeks after the Police Service Commission filed an urgent application in the High Court asking the Court to reverse a suspension order by President Irfaan Ali and to give effect to the Police promotion list released by the PSC, the matter has been fixed for next Wednesday before Justice Gino Persaud.

The Police Service Commission is expected to make its case that the President’s suspension of the PSC was unlawful and illegal and not in keeping with the Constitution.

Attorneys Selwyn Pieters, Dexter Todd, and Dexter Smartt will be appearing for the PSC.

In Court papers filed recently, the PSC wants the Court to grant a declaration that the Commission as presently constituted, remains competent and responsible to fulfill its Constitutional mandate including appointments to any office in the Police Force above the rank of Inspector in accordance with the Constitution.

The PSC also wants the High Court to order that the ranks who were recently promoted by the PSC were properly promoted and the Secretary for the PSC and the Police Commissioner should begin the process for those promotions to be effected.

On the same day that the Chief Justice dismissed a challenge to the Police promotions, the Police Service Commission issued its promotions list. However, the Police Commissioner never acted on the promotions.

A few days earlier, President Irfaal Ali had suspended the entire Police Service Commission, but that suspension was seen as unlawful and was ignored by the PSC.
