The Opposition Leader’s Attorney in the no-confidence case, Anil Nandlall has written the Chief Elections Officer, Keith Lowenfield, requesting that the Commission starts making preparations for elections by September 18.

In the letter seen by News Source, Mr. Nandlall outlined the ruling of the Caribbean Court of Justice validating the passage of the no-confidence motion and reminding the Elections Commission that it was made a party to the CCJ’s proceedings.

Mr. Nandlall said he was acting on behalf of the Opposition Leader and is requesting that the Chief Elections Officer immediately commence preparations for the holding of General and Regional Elections on a date no later than 18th day of September 2019.

Mr. Nandlall wrote that the Chief Elections Officer must be aware, that GECOM, was made a party to the legal proceedings, by the CCJ, so as to make the Orders of the Court directly binding on GECOM.

He said the Chief Elections Officer, Lowenfield is bound by the Court orders.

While refusing to set a date or timeline for the elections, the CCJ said the constitutional provisions that come in wake of a no-confidence vote should kick in.

Nandlall said any actions or omissions on the part of the Chief Elections Officer may be interpreted to be in violation or frustration of the letter and spirit of the Orders and judgments of the CCJ and could expose the Chief Elections Officer to contempt of Court proceedings.

The Chief Elections Officer has not responded to the Nandlall letter.

It is only the President who can announce a date for elections.
