
Almost two years after he first appeared in Court, Assistant Superintendent of Police, Kurt Smith, has been cleared of the Misconduct in Public Office charges that were filed against him by the Special Organised Crime Unit.
On Wednesday, Magistrate Fabayo Azore upheld the no-case submission by the Police Officer’s Attorney, Patrice Henry, and dismissed the six charges that were filed against him.
The Assistant Superintendent was in charge of the Police Force’s Finance Department when he was charged by SOCU for affixing his signature to contracts for the repair of a number of Police buildings.
The Magistrate found that there was insufficient evidence of any wrongdoing by the Police Officer and also found that he had acted lawfully and diligently in carrying out his duties to effect emergency repairs to a number of Police buildings.
The Court found that based on the evidence, the Police Officer did his job in ensuring payments were consistent with the contracts signed for the works.
The Policeman, who was sent on administrative leave after he was charged, is contemplating a lawsuit for malicious prosecution.
In filing the charges, SOCU had contended that the Assistant Superintendent signed the contracts for the repairs to the Police buildings instead of the Permanent Secretary of the Home Affairs Ministry. There were no allegations of fraud, but SOCU still proceeded with the misconduct in public office charges against the Policeman.
