After facing intense questioning by Judges of the Caribbean Court of Justice (CCJ) on whether it was proper for him to publicly comment on the case involving the Mohmaeds while the case continues to engage the Courts, Attorney General Anil Nandlall, said he intends to exercise restraint in commenting on the case in line with the caution issued by the CCJ.
At a hearing on Tuesday on a matter filed by the Mohameds, President of the CCJ, Justice Winston Anderson said while Attorneys have a right to free speech, they also have a responsibility not to publicly comment on pending Court matters.
He said making statements about the case, especially outside of the Court, has the potential to undermine the fairness of the proceedings and public confidence in the process. Justice Anderson asked that there be restraint in public commentary.
Speaking during his weekly “Issues in the News” television programme, Mr. Nandlall said he will adhere to the caution issued by the CCJ.
“The Court before concluded its sitting issued an abomination from all sides that restraint should be exercise in relation to commentary in respect to the matter so in due adherence to that admonition I will exercise that restraint,” Mr. Nandlall said.
Mr. Nandlall has been using his Tuesday television and social media programme to offer commentary on the case since the extradition hearings began.
The Attorney General’s commentary was featured in the arguments put forward by the legal team for the Mohameds as they sought to advance their case of ‘”bias”.
On his programme last night, Mr. Nandlall said he is looking forward to the conclusion of the case before the regional court.
“The Court through its President, Justice Anderson acknowledge that extradition is a process that requires dispatch and that the court will take that into account,” the Attorney General noted.
The CCJ has reserved its decision, and has promised to rule on the matter as soon as practicable.
