The $70 million libel suit filed by Assistant Commissioner of Police, Calvin Brutus against former Chairman of the Police Service Commission, Paul Slowe was dismissed today by Justice Simone Morris-Ramlall.

Last April, Mr Brutus filed a Statement of Claim in the High Court for damages in excess of $60M, in addition to $10M for aggravated and exemplary damages as a result of defamatory statements reportedly made by Mr Slowe between November 22, 2021 and January 12, 2022.

But when the matter came up in the High Court today, Justice Morris-Ramlall dismissed it over breach of the Court’s orders issued during a Case Management Conference (CMC).

Mr Slowe’s Attorney, Mr Nigel Hughes told News Source that the claimant failed to submit an important statement.

“The case was dismissed as a result of the failure of the claimant to file their witness statements,” Mr Hughes explained.

The Attorneys for Mr. Brutus had reportedly failed to seek the Court’s permission for the granting of an extension to file the statements in the matter. Instead, they sought guidance from Mr. Slowe’s Attorneys.

The Judge found the move to be a breach of the procedures of the Court, since the statements were never filed.

Mr Brutus was among five senior police officers, who challenged a decision by the former Police Service Commission not to promote them due to disciplinary matters that were pending at the time. However, the case was dismissed by Chief Justice (ag) Roxane George in June 2021.
