Attorney Sanjeev Datadin, who represented the interests of former Member of Parliament Charrandass Persaud in the no-confidence cases, believes the ruling by the Caribbean Court of Justice makes way for a new Chairman of the Guyana Elections Commission to be appointed and for the President to dissolve the Parliament.
Speaking to reporters moments after the CCJ ruled that the no-confidence motion was properly carried and the appointment of the GECOM Chairman was flawed, Mr. Datadin said the unilateral appointment of the GECOM Chairman in 2017 by President David Granger was bad and retrograde.
“What we hope is for a process that is quick for the appointment of a new Chairman and Parliament should be dissolved, the President should dissolve Parliament and we should go to an election”, Mr. Datadin said.
With the CCJ ruling that the appointment of the GECOM Chairman was flawed and against the constitution, Attorney Datadin said he does not see how the current Chairman could stay on, following the clear ruling of the Court.
With regard to the CCJ ruling that 33 and not 34 is in fact the majority in the Guyana Parliament, Mr. Datadin said that was known all along and it was a travesty that the Guyana Court of Appeal had ruled that 34 votes were needed.
“Everybody in Prep B knows that 33 is the lowest minimum of 65 and reason has been restored to its throne”.
Datadin told reporters that he has informed his client, Charrandass Persaud of the ruling and Persaud is pleased with the outcome.
Charrandass Persaud was the Government Member of Parliament who sided with the Opposition to move the no-confidence motion against the Government.
He left Guyana for Canada the morning after and has never returned.
