AG Chambers to release manual on Condominium Act

Four years after the passage of the Condominium Act, several agencies and other stakeholders are still finding it difficult to operationalize the legislation, Attorney General Anil Nandlall has said.

Mr. Nandlall on Tuesday met with the Guyana Association of Bankers, Registrars of Lands, Commerce and Deeds and Commercial registry and other stakeholders to address concerns raised by the association in relation to the legislation.

Speaking during his weekly “Issues in the News” programme, Mr. Nandlall said some stakeholder are seeking guidance and clarification on the application of the Condominium Act, specifically for the registration of condominiums  as well as registration of mortgages on condominiums in Guyana.

Mr. Nandall said apart from planned frequent engagements, his Chamber is establishing a manual to further clarify the legislation.

“But it is new to Guyana, so we have had some hiccups in operationalization and implementing it and the Banks raised concerns with the President, developers who are developing condominium schemes or who would like to develop condominium schemes as well as persons who would like to purchase condominium units have been approaching the government and saying to us that they are encountering different types of problems in the operationalization and implementation of the legislation of the condominium scheme,” Mr. Nandlall stated.

Mr. Nandlall described the legislation as modern, but noted that because it is new to Guyana, there are some challenges.

In addition to the stakeholders, he said persons building or interested in building condominiums are encountering different kind of problems because of failure to operationslize and implement the legislation.

However, he assured that the legislation protects those who are interested in building or buying condominiums.

“There is nothing in the law that poses a hindrance from you going forward in relation to any of the pursuits to which I have mentioned. The law permits everything that you would like to take place. It is simply reading the law and applying the law. There is a consultant who drafted the law and whom I have instructed to meet again with all the stakeholders and go through with the individually so that they can understand that,” Mr. Nandall noted

The Attorney General believes that following the meeting with the representatives, most of the pressing issues were addressed. However, he said there will be continued engagements until everyone is fully onboard and all hurdles are removed.
