Murder charge against brothers discharged over lack of evidence

Magistrate Chrystal Lambert this morning discharged the murder charges against brothers, Rondell Layne and Mario Moses, over the 2022 beating death of mining ranger, Ricky Oswald Ambrose.

The two brothers were represented by Attorney-at-law, Yuborn Allicock.

In handing down her decision today, Magistrate Lambert referenced her earlier ruling which threw out the alleged confession statement from the two brothers. The Magistrate said a prima facie case for the offence of murder was not established by the Prosecution.

The Prosecution was depending heavily on the confession statements provided by the Police. However, the Magistrate found several issues with those cautionary statements and the manner in which the statements were obtained.

At the end of the preliminary inquiry, the Magistrate said she was unsatisfied that the caution statements presented as evidence in the murder case were freely and voluntarily provided to the Police by the two accused.

Throughout the preliminary inquiry, the Attorney for the two brothers, Yuborn Allicock, repeatedly raised doubt over the confession statements and them being provided freely and voluntarily. He had argued that there was selective recording of the statements by the Police.

The Magistrate found that there was reasonable doubt when the statements were presented, and therefore ruled the statements to be inadmissible. Having provided both the Prosecution and the Defence to submit additional written arguments on that decision, the Magistrate ruled this morning that the matter be fully discharged and the two men be released from prison.

The two brothers were arrested and charged for murder in December last year, and the Police claimed that they had confessed to the crime.

The body of the murder victim, Ricky Ambrose, was found along a trail in a mining area in Region Seven. The brothers were held as suspects after reports surfaced that there was an earlier confrontation between them and Ambrose at a mining camp where they operated. Outside of the alleged confession statements, which were ruled inadmissible by the Court, there was nothing else tying the two men to the murder.
