Two suspects freed of murder charge for lack of evidence after serving 10 years on remand

After spending the last nine years on remand for murder, two men were today freed after the state failed to produce enough evidence to land a conviction.

The two men, Lowell Hope and Sherlund Joseph walked out of the High Court as free men this morning after their continuous plea of not guilty to the murder charge.

The charge was related to the August 2011 murder of Port Kaituma resident, Kenny Creame.

In court today, the attorney representing the two men made a successful application for the indictment to be quashed because of the lack of evidence.

The lawyer contended that there was no eye witness, forensic evidence or even circumstantial evidence in the case.

The Prosecution responded that during the preliminary inquiry, some of the witnesses never appeared in Court and therefore evidence could not have been gathered from them.

Justice Sandel Kissoon explained that the two men were on remand for 10 prison years and therefore he felt it best to acquit them of the indictment.
