Acting Chief Justice Navindra Singh has dismissed one of the two cases filed by the Nazar and Azruddin Mohamed in the High Court challenging the ongoing extradition proceedings against them in the Magistrates’ Court.
In a ruling yesterday, Justice Singh rejected the claims by the Mohameds that state officials acted with political bias by signing off on the extradition request from the United States. Acting Chief Justice Singh said it would be absurd to suggest that a state official, in this case a Minister of the Government, is disqualified from exercising their statutory powers because the affected person is a political opponent.
Azruddin Mohamed is the Leader and a Member of Parliament of the WIN Party. He was recently elected Opposition Leader, which is a Constitutional office.
In the ruling, the Judge said he found no evidence of the Minister acting in bad faith or personal interest.
He also awarded costs against the Mohameds in the matter.
The other case that remains before the High Court relates to the claim by the Mohameds that sections of the Fugitive Offenders Amendment Act are unconstitutional. A ruling on that matter is expected within days.
Attorney General Anil Nandlall has welcomed yesterday’s ruling of the High Court. He has repeatedly stated that state officials carried out their duties and functions legally once the extradition request for the billionaire father and son was received.
The extradition proceedings against the Mohameds will continue in the Magistrates’ Court.
