Attorney Nigel Hughes who is representing Gladston Henry in the Haresh Singh murder case has declared that the Police Force has already set the stage for a miscarriage of justice with the charge against Henry.
Henry who is the brother of one of the Henry cousins murdered last year in the Berbice area was charged along with three other men yesterday for the murder of Haresh Singh who was found murdered in the aftermath of the Henry boys killing.
In an interview with News Source, Attorney Hughes said while his client provided a full alibi on the day of Haresh Singh’s murder, that alibi and the statements from 10 witnesses were ignored by the Police.
The Attorney explained that after a wanted bulletin was issued for Gladston Henry, he accompanied him to CID where he was questioned about his whereabouts on the day of Haresh Singh’s murder.
He said Henry opted to remain silent and after the interview he (Hughes) informed the officers at CID that there are several eyewitnesses who are willing to come forward to confirm that Henry was somewhere else, pointing out that the same day that Haresh Singh was murdered, Gladston family members were watching a live video of the post mortem examination of his brother and cousin.
“Ten alibi witnesses, some from the Corentyne and other parts of Berbice attended our offices and gave statements to us about where Gladston Henry was on the 9th September when Haresh Singh was murdered and all of them said that all of them were gathered at the home- which is the home of Gladston and Patrcia Henry, they were watching the post-mortem on the phone because Mr. Henry was actually at Le repentir where the post mortem was being conducted and he was video recording it,” Hughes said.
The Attorney said the information was relayed to the investigating officers, but they repeatedly said they received no word from their seniors to act on that information.
The Attorney said he then informed the Head of the Major Crimes Unit of the statements given by the 10 witnesses and explained to him that the witnesses are willing to come forward. Hughes said told him he (Hughes) could take the statements himself, which. he did and later handed them over to the Police on Monday afternoon.
He said on Tuesday morning, he emailed the Director of Public Prosecutions (DPP) informing her of the development.
Hughes said all of Tuesday he attempted to contact Senior officers at CID to find out what the position of the case in relation to Gladston Henry but got no answer. He said he later learnt that the police were traveling to West Berbice to have the men charged.
“Purely by accident, that about 2:30- 3:00 in the afternoon we got wind that the police have travelled to Berbice to file charges against these four men while they were in custody in Georgetown, behind the backs of their lawyers, behind the backs of the men, behind the backs of their family members, all of whom were around waiting to find out what had happened,” Hughes said.
Hughes said he informed the magistrate, via zoom that he believes that there has been a serious risk of a miscarriage of justice because several persons have confirmed the whereabouts of Henry at the time Haresh Singh was murdered.
“None of those witnesses, as far as I am aware, not one of the 10 have been contacted by the police to even investigate what they have said in relation to the whereabouts of Mr. Henry on the 9th, the morning of the 9th when Mr. Haresh Singh was murdered,” the Attorney told News Source.
Hughes contends that there is a serious miscarriage of justice since no investigation was conducted into the alibi received.
