Court dismisses supply of expired HIV testing kits case for lack of evidence

Technical Consultant, Davendra Rampersaud, who was accused of allegedly providing the Ministry of Health (MOH) with fake HIV testing kits walked out of Court as a free man today as the Magistrate dismissed the case due to insufficient evidence.

Rampersaud was charged back in 2020 for allegedly supplying 400 units of expired HIV testing kits to the Ministry of Health. The case was filed by the Government Food and Drug Analysts Department.

 Mr. Rampersaud who was a representative of Caribbean Medical Supplies Inc. always denied the allegations.

Today, the presiding Magistrate accepted a no-case submission that was filed by his Attorneys.

The Court agreed that the Prosecution had failed to provide essential elements of the charge and did not provide evidence to back its claim.

The Court also found that the Prosecution had also failed to produce any evidence that Mr. Rampersaud or the company he represented, ever imported the testing kits.

The matter was dismissed.

Back in January 2020, the Ministry of Health launched a probe into the supply of the testing kits after the Irish manufacturer wrote to the Government, warning that counterfeit testing kits carrying its brand might have been sold in the Guyana market.

The investigation found that the testing kits had expired and the charges were therefore laid against the supplier.
