Former Assistant Commissioner of Police, Calvin Brutus, has withdrawn a case that he recently filed challenging the appointment of a Tribunal that led an investigation into discipline claims against him.
The matter which was before the Acting Chief Justice was withdrawn yesterday. It was filed on the 27th January while the Tribunal was still doing its work, but the first hearing came after the Tribunal had already completed its work and recommended Mr. Brutus’ dismissal from the Police Force.
One day after the Tribunal recommended his dismissal, the Police Service Commission acted and fired him from his job. He has since vacated his living quarters within the Guyana Police Force.
It is unclear whether he will now file a new case challenging the Tribunal’s legitimacy and its decision.
In challenging the establishment of the Discipline Tribunal, Mr. Brutus through his Attorneys contended that the Tribunal would have breached his Constitutional right as well as law and due process since it was examining an issue that was already before the Court.
Mr. Brutus is currently facing more than 250 criminal charges in the Court related to accusations of money laundering and other financial crimes. He has declared his innocence.
The Disciplinary Tribunal in its report found that there was a pattern of planned, deliberate and reprehensible conduct by Mr. Brutus.
Brutus was fired last Wednesday after being found guilty by the Tribunal of two disciplinary charges that were filed against him.
In a statement on Wednesday night, the Police Service Commission announced its decision to dismiss Mr. Brutus from the Guyana Police Force. It said that decision came after a thorough review of the report and recommendations of the Tribunal that it had established.
