Interim injunction temporarily blocks vote recount

Even as the Guyana Elections Commission was preparing for a vote recount while examining legal issues surrounding such a recount, an interim injunction has been granted against the Commission preventing the recount at this time.

The injunction was granted by Justice Franklin Holder this afternoon following an application made by a private citizen, Ulita Moore.

The interim injunction restrains the Guyana Elections Commission from setting aside or varying the declarations already made by the 10 electoral districts with any other documents or declarations until the hearing and determination of the judicial review of the application.

An interim injunction was also granted restraining the Chief Elections Officer from submitting any report of the total votes cast for each list of candidates save and except the votes counted and the information furnished by the Returning Officer under the representation of the People Act.

The Guyana Elections Commission has also been restrained from permitting or authorizing any person or persons to any agreement between the President of Guyana and the Leader of the Opposition or any agreement between the Guyana Elections Commission and the Caribbean Community or at all, to count or recount any ballots cast by electors on the 2nd March 2020.

Additionally, the Court has ordered that the Elections Commission be restrained from permitting or authorizing any person or persons pursuant to any agreement between the President and the Opposition Leader or any agreement between the Commission and CARICOM to count or recount any ballots cast at the elections.

The respondents to the Court matter are the Guyana Elections Commission, the Chairman of the Commission and the Chief Elections Officer.

The matter is set to come up in Court on the 20th March.

There could be moves before that time to challenge the injunctions and possibly have them dismissed.
