The People’s Progressive Party through three Attorneys and the party’s Presidential Candidate and its General Secretary entered the case against the Guyana Elections Commission as a respondent.

Attorney Anil Nandlall who is among the party’s Attorneys believes that the matter is a vexatious one that ought to be thrown out by the Court.

Mr. Nandlall explained to News Source that in his view there is the issue of jurisdiction to hear the matter and he is of the opinion that while the matter may be an important one, it is in the wrong Court.

“I understand that there is a cross-section of Guyanese who honestly feel that there are issues that must be ventilated and I appreciate that, and I am not insensitive to that but the law is the law and the law provides a forum and a place and a stage where those issues are to be ventilated. And what in my view has been done here is completely wrong. You can’t dress up a matter to look like in order to fit it into a special jurisdiction that the Court has created. The Court has created also a specific jurisdiction to deal with the type of allegation that the lawyer wants to canvas”.

He said he understands why the Court is proceeding with hearing the matter since it is in the public’s interest and therefore the Judges would want to ensure a fair hearing.

But Mr. Nandlall said he still expects that the Court will dismiss the matter since he has “no doubt that the Court wants to dismiss this matter and I have every hope that it will do so and so that GECOM could determine the matter quickly”.

Nandlall said the legal procedures to ventilate the matters should be followed and that would take everything being taken before the Court right now into an election petition.

The Attorneys in the case have up to 6am tomorrow to submit their oral arguments and they will appear before the three Judges hearing the matter from 11am to begin their oral submissions.

Only the lead attorneys for each party in the matter will be making oral submissions.
