Nandlall files court action against President’s directive to Police Service Commission

The Attorney in the Court filing noted that the the Police Service Commission is an independent Commission established by the Constitution of Guyana and by virtue of Article 226 of the Constitution of the Cooperative Republic of Guyana, in the exercise of its functions, that Commission shall not be subject to the direction or control of any other person or authority.

Nandlall files court action against President’s directive to Police Service Commission

Just a week after threatening legal action against the move by the President through his State Minister to get the Police Service Commission to halt promotions, former Attorney General, Anil Nandlall has followed up on the threat and has started legal proceedings.

The court action has been filed in the name of Rajendra Jaigobin.

He wants the Court to declare that the Police Service Commission, a Commission established by the Constitution of the Cooperative Republic of Guyana, in the exercise of its functions shall not be subject to the direction or control of any other person or authority.

Nandlall believes the President cannot request the Commission to halt promotions.

He also wants the Court to declare that the letter sent to the Commission requesting the hold, is unlawful, null, void and of no legal effect.

President David Granger has stated that the move to request that the promotions be put on hold came following complaints from Police Officers about their promotions being blocked in the past.

“Damage could be done if persons who are not fit and proper make decisions which are injurious to public security, so we’re taking a second look at it. We want the constitution commission to function efficiently, but at the same time we want to make sure that the public can depend on the decisions which come out of those commissions as being in the best interest of the nation”, the President told the media.
